These Terms of Service (“Terms”) govern your use of the applications, websites, text messaging services, and related services provided by Blue Clover, LLC (“Blue Clover,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms.

Blue Clover helps users keep track of responsibilities, commitments, and things that need to be taken care of, including who is responsible and whether an item has been completed or requires attention.

Blue Clover may provide reminders, confirmations, status information, communications, and other organizational features.

You are responsible for providing accurate account information, maintaining the confidentiality of your account credentials, and for activity occurring through your account.

You agree not to misuse the Services or use Blue Clover for unlawful, fraudulent, abusive, harassing, or unauthorized purposes.

Some Blue Clover features allow you to identify or provide information concerning other people.

You are responsible for ensuring that you have an appropriate basis to provide such information to Blue Clover and to involve another person in a Blue Clover activity.

Blue Clover will not send that person Blue Clover SMS confirmation or follow-up messages unless the applicable mobile number has separately opted in to receive Blue Clover SMS messages.

Users may separately and voluntarily opt in to receive Blue Clover customer-care confirmation and follow-up text messages.

SMS consent is optional and is not a condition of using Blue Clover.

Message frequency varies. Message and data rates may apply.

To stop receiving Blue Clover text messages, reply STOP. After an opt-out request is processed, no additional Blue Clover SMS messages will be sent to that number unless the recipient subsequently opts in again.

Wireless carriers are not responsible for delayed or undelivered messages. Your wireless carrier's messaging and data charges may apply to messages you send and receive.

Blue Clover may use third-party communications providers to deliver text messages.

Blue Clover may allow users and other participating people to provide confirmations or status information concerning responsibilities or activities.

Blue Clover facilitates the exchange and organization of this information. You remain responsible for determining whether information provided through the Services is accurate and appropriate for your purposes.

You may not use Blue Clover to violate applicable law; impersonate another person; send unlawful, deceptive, threatening, abusive, or unsolicited communications; interfere with or disrupt the Services; attempt unauthorized access to Blue Clover systems or accounts; or use the Services in a manner that infringes the rights of others.

We may modify, update, suspend, or discontinue features of Blue Clover from time to time. We do not guarantee that every feature will always be available or operate without interruption or error.

Blue Clover and its software, designs, trademarks, logos, content, technology, and other intellectual property are owned by Blue Clover, LLC or its licensors and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of Blue Clover intellectual property to you.

The Services are provided on an “as is” and “as available” basis to the extent permitted by law.

Blue Clover is an organizational and communication service. It is not intended to provide legal, financial, medical, emergency, or other professional advice, and you should not rely on Blue Clover as a substitute for appropriate professional advice or emergency services.

To the maximum extent permitted by applicable law, Blue Clover, LLC and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

You may stop using Blue Clover at any time.

We may suspend or terminate access to the Services when reasonably necessary to protect Blue Clover, other users, third parties, or the integrity of the Services; address violations of these Terms; or comply with applicable law.

We may update these Terms from time to time. When we do, we will update the effective date above. Your continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.
